Chairman Burmeister called the meeting to order at 9:04 a.m.
Motion made by Anderson to approve the minutes of the February meeting, second by Olson. Motion carried.
Flanigan read the Notice of Public Hearing as published in the Burnett County Sentinel. A public hearing was held on the following Conditional permits, Rezone, and Sanitary Variance:
CONDITIONAL PERMIT #1240 - UTHE
Dale and Vicki Uthe are requesting a conditional permit for a tourist or transient rental dwelling, located in the RR-3 zoning district, on Lot 4 CSM V. 17 P.140 in the SW ¼ of the NE ¼, Section 25, T41N R16W, Town of Swiss.
Bill Klugow was representing Dale and Vicki Uthe. The home is rented 2 to 3 times a year to family and friends. Mr. Klugow is the caretaker for the property.
Flanigan explained the permitted uses and conditional uses in the RR-3 zoning district. It was also explained that a state license for rental would be required. Flanigan indicated that this type of use in a residential zone has potential to create conflicts and would compete with existing resorts, motels etc. and rental of lake home may be even a greater slippery slope.
No correspondence was received and there were no objections from the Town, per Chairman Klugow.

Motion made by Olson to APPROVE Conditional Permit #1240 as requested, second by Anderson. Falk opposed. Motion carried.
CONDITIONAL PERMIT #1241 - MCDOWELL
Merritt and Teresa McDowell are requesting a conditional permit to reopen a quarry/gravel pit, located in the A-2 zoning district, in the SW ¼ of the NE ¼ of the W ½ of the SE ¼, Section 9, T40N R16W, Town of Oakland.
Mrs. McDowell was present. An erosion control plan is in place.
The Zoning Committee reviewed Section 6.2 of the Land Use Ordinance dealing with quarries/gravel pits. The Ordinance used to require renewal of permits every 3 years. When the Ordinance was amended requiring compliance with the Burnett County Non-Metallic Mining Ordinance and NR135, this 3-year renewal/review was deleted. The Committee determined that the 3-year review/renewal was no longer required for previously issued permits.

REZONE #2006-03 RAWLINGS
John Rawlings is requesting to rezone the NW ¼ of the SE ¼, Section 19, T38N R14W, Town of Dewey from A (Exclusive Agricultural with a minimum lot area of 35 acres) to A-4 (Ag/Forestry/Residential with a minimum lot area of 40 acres with a one-time additional split of a 1 to 5-acre parcel per 40 acres) zoning district.
Mr. Rawlings was present. He asked to change from his original request for rezone from A to A-4, to a change from A to A-2 with a 1-time split. Mr. Rawlings indicated he wanted to go with the A-4 zoning, but couldn't as the lakebed, when surveyed, would leave him with much less than 40 acres. It could not meet the minimum 35 acres required by A-4 zoning. It was noted that this was a unique parcel in that it had unmeandered lakebed on the property, and the surrounding property on the lake was zoned RR-1 and A-2. It was also noted that area of the proposed split was lakebed, wetland, and woodland.

Motion made by Anderson to recommend APPROVING Rezone #2006-03 to the A-2 zoning district, subject to Town approval, second by Falk. Motion carried.
SANITARY VARIANCE #06-01 MURPHY
Ben Murphy, is requesting a permit to install a holding tank instead of a mound system, located in an the RR-1 zoning district, on Lot 5 Plat of Lake 32, Section 33, T37N R14W, Town of Roosevelt.
Mr. Murphy was present. Flanigan reviewed the Burnett County Sanitary Ordinance with the members and noted that a holding tank is not a system of choice. A soil test has been done and it indicated that a mound system would need to be installed. Flanigan noted that the yearly average would not exceed 150 gallons per day. Other options were discussed. Mr. Murphy indicated that this system would have very limited seasonal use and that when the subdivision association brings electricity in, he plans to have a mound system installed.

Motion made by Falk to APPROVE Sanitary Variance #06-01 with the conditions that a code-compliant holding tank is installed, the daily discharge rate of 150 gallons is not exceeded, and a sanitary permit must be secured within 1 year of the Association bringing in electricity, motion second by Sybers.
CONDITIONAL PERMIT #1242 - JOHNSON
Harold Johnson is requesting a conditional permit to keep livestock on his property, located in the RR-2 zoning district, in Government Lot 6, Section 8, T40N R14W, Town of Scott.
Mr. Johnson was present. He would like to keep horses and chickens, no roosters, and maybe pheasants and grouse at a later date. He will not be boarding animals.
Daniel and Linda Hahn, adjoiners, sent a facsimile and mailed a letter regarding concerns about livestock negatively impacting the enjoyment of the neighboring properties. They have concerns about odors, noise, and waste drainage into the lake. He would prefer that the proposed barn be situated closer to Long Lake Road, away from lakeshore properties.
Jeffrey Bulger, an adjoiner, sent a facsimile stating concerns about noise, odor, fences, structures to house the animals, and waste removal measures. He would also prefer that the proposed barn be situated closer to Long Lake Road.
Kathleen Wagner had called to express the same concerns that Mr. Bulger had.
There were no public comments.
Motion made by Anderson to Table this application to wait for responses from the Fish Lake lake association and the Township and a site visit, second by Falk. Anderson amended the motion to POSTPONE this application until the April meeting so that the Zoning Committee could possibly visit the site, second by Falk. Motion carried.
CONDITIONAL PERMIT #1243 - WOLF
Ryan and Laura Wolf are requesting a conditional permit for an expanded home occupation of a taxidermy shop, located in the RR-1 zoning district, on Lot 2 CSM V.6 P.18 in Government Lot 3, Section 3, T38N R16W, Town of Siren.
Mr. Wolf was present. Traffic is estimated to be 0 to 3 cars a day and a delivery truck periodically. There will be weekly garbage pickup.
Mr. Wolf's neighbors were present and stated they have no objections to the Conditional Use permit.

CONDITIONAL PERMIT #1244 - BROWN/HALSETH
Charles and Michelle Brown and Thomas Halseth are requesting a conditional permit to keep livestock on their property, located in the RR-3 zoning district, in the E ½ of the SE ¼ of the SW ¼, Section 15, and in the NE ¼ of the NE ¼ of the NW ¼, Section 22, T40N R16W, Town of Oakland.
Mrs. Brown was present. The Township sent their approval. Discussion was held regarding numbers of animals, existing uses, etc.

OTHER BUSINESS
Wagner Surveying - Preliminary Plat Review for David Kramer:
Flanigan asked the Committee what should be done with the parcel on the west side of the road. Mark will continue his work on the plat and will attempt to resolve the issue.
